Surrogacy at a Crossroads: What Is Happening in Ukraine and Georgia
Recently, surrogacy has once again moved to the centre of public and political debate. Both Ukraine and Georgia are discussing legislative initiatives that could significantly change the rules of the field.
What is happening now
For many years, Ukraine had one of the most transparent legal frameworks in this area, with clear regulations for both Ukrainian and international couples. This made the country one of Europe’s centres of reproductive medicine. Georgia developed along a similar path.
Both countries are currently considering initiatives aimed at restricting or banning surrogacy. Supporters of these changes cite concerns about the potential exploitation of surrogate mothers and ethical questions surrounding the commercialisation of reproduction. Opponents of a ban, in turn, warn that strict restrictions are more likely to push the practice underground than protect women, while depriving many people, including those facing infertility, of a legal path to parenthood.
Why this matters for the industry
This is not solely a legal issue. It concerns the health, rights and dignity of everyone involved: surrogate mothers, intended parents and children. The experience of countries where the practice is regulated rather than prohibited, such as Canada, shows that a balanced system with medical oversight, legal protection for surrogate mothers and transparent agreements can operate ethically and safely.
